Chinese herbal tea brands in lawsuit

The Higher People's Court in southern China's Guangdong province has opened an infringement case between two leading brands of herbal tea. The two brands, Jia Duo Bao and Wang Lao Ji share very similar packaging and advertising.

The Guangzhou Medicine Corporation says that it owns the right to the package design with the distinctive red can, after acquiring the business of the Wang Lao Ji herbal tea. But Jia Duo Bao argues that it's the first user of the design. Jia Duo Bao said it was granted the patent of the red can design after signing a license contract in 1995.
